How JMW helped a Claimant get the funding she needed after a life-changing injury
We currently act for a Claimant who was a pedestrian when she was struck by the Defendant’s vehicle. The Claimant has no recollection of the accident and suffered life-changing injuries including a severe traumatic brain injury (TBI) along with multiple pelvic fractures and fractures to her humerus and fibula. The Claimant’s mother gave up her full-time employment after the accident to care for her daughter.
JMW were instructed to deal with the personal injury claim. We secured an early admission of liability and interim payments including a payment for the Claimant’s mother to take account of the additional care and assistance she has provided to her daughter as a result of the accident.
The Claimant suffers with poor memory and concentration. She needs prompting and support with planning and organising and her mother has noted a change in her behaviour since with the accident including anger outbursts. The Claimant also struggles to regulate her emotions and suffers with anxiety.
The Claimant was attending secondary school when the accident happened. We contacted the Defendant’s insurers at the earliest possible opportunity to secure funding for an immediate needs assessment (INA) with a case manager with expertise of brain injury claims. The case manager prepared an INA report which made several recommendations and provided costings for the recommended package of rehabilitation and support to be provided privately. This included moving to a more suitable house, which the case manager arranged.
We secured funding to implement the package recommended by the case manager. The Claimant now has a fully funded MDT (multi-disciplinary team) including a case manager, neuropsychologist, physiotherapist, occupational therapist and speech and language therapist to coordinate her rehabilitation. The MDT engaged with the Claimant’s school to assist with an Educational and Health Care Plan (EHCP) and the support from her MDT has enabled the Claimant to embark on a college course which would not otherwise have been possible as a result of the life-changing injuries suffered in the accident.
We are currently looking to finalise various expert reports so that the claim can be properly valued which will be a multi-million-pound settlement.
